BLS Logic 2

Syllabus:


1- Mediate inference - Syllogism - Figures and moods - testing the vali9dity of arguments.

2- Reduction - Aristotle's dictum de omni et nullo and the first figure direct reduction and indirect reduction.

3- Hypothetical and disjunctive arguments -  Rules and fallacies in the arguments with reference to law. Analysis of rules of inference and rules of replacement.

4 - Dilemma - Types of Dilemma, refutation of dilemma, value of dilemma in law.

5 - Fallacies - various fallacies, their kinds and relation to law

6 - Hypothesis - Conditio9ns of good hypothesis, Kinds of hypothesis

7 - Hypothetico deductive method - Stages of the method as used in science, method of enquiry in law

8 - Causation - Concept of cause, common sense notion of cause, scientific notion of cause, plurality of causes, maxims in relation to causation - causation in legal reasoning; (i) In jure non remota cauased proxima spectator - in law immediate and not the remote cause is considered; (ii) Vis major/ Actus dei neminifacit injuriam - Law holds no man responsible for the act of God; (iii) Volunti non fit injuria - Damage suffered by consent is not a cause of action; (iv) Respondeat superior - an employer is responsible for the actions of employees performed within the course of their employment.

9- Uses of language - Emotive words - emotively neutral language, kinda of agreement and disagreement, impediments in good reasoning,

10 - Application of Logical reasoning - Equality and its implications, Ends and means
